Helical Pier & Bracket Installation

1. Scope of Coverage Subject to the terms and conditions set forth below, ROC Builders ("Company") warrants solely to the original property owner ("Owner") that the helical piers and attached bracket assembly systems installed by the Company (collectively, the "Helical System") will remain free from settlement or movement resulting from structural failure of the Helical System itself for the lifetime of the property, effective from the date of completion.

This warranty covers:

The structural integrity of the steel helical piers and bracket assemblies installed by the Company.

Remedial action (repair, re-adjustment, or replacement) in the event of downward movement or settlement directly caused by a failure of the Helical System.

2. Non-Transferable Agreement This Warranty is issued exclusively to the original purchaser named on the initial contract and applies solely to the specific real property located at the contract site address. This Warranty is non-transferable and automatically terminates upon any transfer of ownership, sale, conveyance, or assignment of the property.

3. Exclusions & Limitations This Warranty is strictly limited to the Helical System installed by ROC Builders. No other portion of the structure, foundation, framing, finishes, or property is warranted under this agreement.

ROC Builders shall NOT be liable for any structural failure, movement, settlement, or damage resulting from factors unrelated to a defect or failure in the Helical System itself. Explicitly excluded from coverage are:

Unrelated Structural Failure: Damage or movement caused by failure, shifting, or deterioration of wood framing, footings, concrete slabs, foundation walls, beams, joists, masonry, or any structural elements not directly manufactured and installed by ROC Builders as part of the Helical System.

Environmental & Soil Dynamics: Soil movement, slope instability, sinkholes, landslides, soil erosion, flooding, earthquakes, high water tables, or changes in site conditions beyond the Company’s control.

Third-Party Modifications: Unapproved structural alterations, additions, heavy loads, or modifications made to the property after installation.

Water & Drainage Issues: Water intrusion, plumbing leaks, poor surface drainage, or roof runoff issues that compromise surrounding soils or structures.

Acts of God & External Force: Acts of Nature, severe weather, fires, vehicle impact, or explosion.

Consequential & Incidental Damages: ROC Builders is not responsible for secondary, consequential, or cosmetic damage (e.g., drywall cracks, misaligned doors/windows, cracked tile, floor buckling) resulting from initial structural settlement, subsequent movement, or warranty repair work.

4. Exclusive Remedy In the event of a valid claim under this Warranty, ROC Builders' sole obligation shall be to repair, re-adjust, or replace—at the Company’s discretion—the affected helical piers and brackets installed by the Company. The Company’s maximum liability shall not exceed the original total purchase price paid for the installation of the Helical System.

5. Claim Requirements To initiate a claim, the Owner must notify ROC Builders in writing within 30 days of discovering any suspected failure or movement. The Owner must provide proof of original ownership and allow the Company reasonable access to inspect and evaluate the site prior to any third-party repair work.
